Rocket Tax™ Terms of Service
March 15, 2022
Rocket Tax™ is a Service offered by Rocket Lawyer that enables users to file certain types of tax returns. All uses of Rocket Tax are subject to these Rocket Tax Terms of Service and the General Terms (together, the “Terms”). The General Terms are incorporated herein by reference. Capitalized terms not defined in these Rocket Tax Terms of Service have the meanings ascribed to them in the General Terms. If there is any conflict between the General Terms and these Rocket Tax Terms of Service, the Rocket Tax Terms of Service will control.
Tax Filing Partners
To enable the Rocket Tax Service, Rocket Lawyer utilizes the services of Tickmark, Inc. d/b/a Taxfyle (“Taxfyle”). To use the Rocket Tax Service you must complete Taxfyle’s onboarding process, accept the Taxfyle Terms of Service (the “Taxfyle Terms”), and create a Taxfyle account. Taxfyle will then refer you to a Third-Party Tax Professional (as defined in the Taxfyle Terms) to complete your filing. By using the Rocket Tax Service, you agree to be bound by the Taxfyle Terms, as the same may be modified by Taxfyle from time to time.
Permitted Use
You must not use the Rocket Tax Service for any activity that is prohibited by these Terms, applicable law or the Taxfyle Terms. We reserve the right to limit or terminate your use of the Rocket Tax Service at any time without notice if we believe you may be using the Rocket Tax Service in violation of these Terms, applicable law or the Taxfyle Terms.
Information Collection
As a condition of using the Rocket Tax Service, you agree (1) to provide complete and accurate information about you and your business, as applicable, and (2) that Rocket Lawyer may share this information with Taxfyle. By agreeing to these Terms or using the Rocket Tax Service, you consent to the collection, use and sharing of your information as set forth herein, in Rocket Lawyer’s Privacy Policy, and in the Taxfyle Privacy Policy.
Disclaimers; Indemnification
Rocket Lawyer does not provide tax filing or accounting services. The Rocket Tax Services are fulfilled by Third-Party Tax Professionals. By using the Rocket Tax Service and agreeing to these Terms, you assume all risks arising from the use of the Rocket Tax Service to file your tax return documents. YOU AGREE THAT ROCKET LAWYER IS NOT RESPONSIBLE FOR REVIEWING, PREPARING OR FILING YOUR TAXES. ROCKET LAWYER UNDERTAKES NO OBLIGATION TO REVIEW ANY DOCUMENTS YOU PROVIDE TO TAXFYLE OR THIRD-PARTY TAX PROFESSIONALS OR ANY TAX RETURN DOCUMENTS PRODUCED BY TAXFYLE, THIRD-PARTY TAX PROFESSIONALS, OR ANY OTHER THIRD-PARTY PROVIDER. ROCKET LAWYER MAKES NO REPRESENTATIONS OR WARRANTIES, EXPRESS OR IMPLIED, REGARDING THE SERVICES PROVIDED BY TAXFYLE OR THIRD-PARTY TAX PROFESSIONALS. ROCKET LAWYER AND ITS AFFILIATES, AND ITS AND THEIR RESPECTIVE OFFICERS, EMPLOYEES, DIRECTORS, AND AGENTS (COLLECTIVELY, “RL REPRESENTATIVES”) DISCLAIM ALL LIABILITY ARISING FROM THE FAILURE OF TAXFYLE, THIRD-PARTY TAX PROFESSIONALS, OR ANY OTHER THIRD-PARTY PROVIDER TO PERFORM THEIR RESPECTIVE OBLIGATIONS. BY USING THE ROCKET TAX SERVICE AND AGREEING TO THESE TERMS, YOU AGREE TO WAIVE ANY CLAIMS AGAINST ROCKET LAWYER OR ANY RL REPRESENTATIVE, AND NOT TO SUE ROCKET LAWYER OR ANY RL REPRESENTATIVE, IN CONNECTION WITH ANY DISPUTE ARISING FROM YOUR USE OF THE ROCKET TAX SERVICE OR FOR ANY ERRORS, ACTS, OR OMISSIONS OF TAXFYLE, ANY THIRD-PARTY TAX PROFESSIONAL, OR ANY OTHER THIRD-PARTY PROVIDER. You agree to indemnify and hold harmless Rocket Lawyer and all RL Representatives to the maximum extent permitted by applicable law for any damages, losses, costs, or expenses (including attorney fees) incurred by Rocket Lawyer or any RL Representative in connection with your tax filings.
Avoiding Disputes
If you have a dispute with Taxfyle, a Third-Party Tax Professional, or any tax authority, you may elect to discuss the matter with your accountant or attorney. Rocket Lawyer is not your accountant or attorney and cannot represent you in a dispute. Accordingly, we urge you to carefully review your tax documents, and confirm that they contain accurate information, before you authorize Taxfyle or a Third-Party Tax Professional to file your tax returns on your behalf. You are solely responsible for ensuring that your tax return documents are correct. If there is any dispute between you and Rocket Lawyer arising from your use of the Rocket Tax Service, the dispute shall be subject to the arbitration provisions and the class action waiver as provided in the General Terms.
